FACTA: What You Need to Know

Fair and Accurate Credit Transactions Act of 2003 (FACTA), calls for the proper disposal of information in consumer reports and records to protect against “unauthorized access to or use of the information.”  www.ftc.gov The disposal rule requires businesses and individuals to take proper steps to dispose of sensitive information.  Any business or individual who uses a consumer report for business purposes is subject to the requirements of this rule.  

 

FACTA is designed to protect consumers personal information such as:

  • Name

  • Email

  • Address

  • Date of birth

  • Phone number

  • Social security number

  • Driver’s license number

  • Credit card numbers

  • Credit reports/score

  • Medical history

Failure to comply with FACTA disposal rules can result in fines, and a poor reputation resulting in a loss of business.  Individuals who become victims of identity theft due to your company's failure to follow FACTA laws can seek damages under the law.
